Terms and conditions

These conditions govern contracts concluded online, and the Buyer’s acknowledgement and acceptance of them is an essential condition and a prerequisite for the conclusion of the contract.

  1. Contract definitions:

“Online sales contract” means the sales contract for the Supplier’s products, concluded between the Supplier and the Purchaser through a remote sales system using electronic means, organised by the Supplier.

The term “Purchaser” refers to the natural person who makes the purchase indicated in this contract, for purposes not related to a commercial or professional activity; it also refers to the person who purchases the goods for commercial or professional activities.

“Supplier” is the person who, in agreement with the manufacturer, offers the products for sale.

  1. Object of the sale:

The products covered by these general conditions are sold by Azienda Agricola I Roccoli di Annamaria Giacometti, hereinafter referred to as the “Supplier”, with head office in Strada Corrubio, 3 37011, Bardolino (Verona), VAT number 04227840230, registered with the Verona Chamber of Commerce under number REA VR-416704, certified e-mail address giacomettiannamaria@legalmail.it; the products on sale are described in an online catalogue with specific data sheets describing their characteristics and including photographs, albeit of a merely indicative nature, as well as prices.

  1. Conclusion of the contract

The contract between the Supplier and the Purchaser is concluded exclusively via Internet. On the website www.iroccoli.it, the Purchaser must follow the procedures indicated, to formalise the proposal for the purchase of the goods offered for sale.

  1. Conclusion and efficacy of the contract

The purchase contract is concluded by filling in the request form, the consent for purchase expressed through the adhesion sent online, after viewing the pre-contractual information pursuant to art. 49 of Legislative Decree no. 206/2005, the order summary, which shows the details of the ordering party and the order, the price of the goods purchased, the shipping costs and any additional charges, the payment methods and terms, the address to which the goods are to be delivered, the delivery times and the absence for the purchase of these products of the right of withdrawal, because they come under the exception referred to in art. 59, para. 1, lett. d) of Legislative Decree no. 206/2005.
The Purchaser may print or store – on a durable medium, paper or electronic – the documents displayed during the purchase phase and indicated above.
After the Supplier receives the Purchaser’s order, the Supplier shall send a confirmation e-mail or display a web page confirming and summarising the order, which can be printed or stored on a durable medium, paper or electronic, and which also contains the data referred to above. The contract shall be deemed to be concluded and effective between the parties when this e-mail communication has been sent or the dedicated web page viewed.

  1. Methods of payment and refund

Payments by the Purchaser may only be made by one of the methods indicated on the dedicated web page by the Supplier and indicated in detail in the pre-contractual information. The Supplier guarantees the security of the processes for storing this information, in compliance with the provisions of the current regulations governing the protection of personal data, using the PayPal system.
